Legal assistance in child support and child maintenance matters is primarily provided by the Victoria Legal Aid (VLA) Child Support Legal Service and by community legal centres.
Where a person has sought and is unable to obtain assistance from our Child Support Legal Service or a community legal centre, a grant of legal assistance may be available for adults and children under the following guidelines:
- Guideline 5.1 – advice and negotiation for adults in child support matters
- Guideline 5.2 – litigation and administrative review for adults in child support matters
- Guideline 5.3 – advice and negotiation for adults in child and adult child maintenance matters
- Guideline 5.4 – FDRS in adult child maintenance matters
- Guideline 5.5 – litigation for adults in child and adult child maintenance matters
- Guideline 5.6 – advice and negotiation for children in child support and child maintenance matters
- Guideline 5.7 – litigation for children in child support and child maintenance matters.
This may include assistance:
- to discharge or vary a child maintenance order (see Guideline 5.5)
- to apply for or respond to an application for enforcement a child maintenance order (see Guideline 5.5)
- to apply for or respond to an application for arrears of child support or maintenance (see Guideline 5.2 and Guideline 5.5), and
- appeals (see Guideline 8).
