Guideline 4 – equal opportunity and discrimination cases

Victoria Legal Aid (VLA) may make a grant of legal assistance to a person for an equal opportunity or discrimination case if VLA is satisfied that there is a strong prospect that there will be a benefit to the person.

Documentary Requirements

Applications under this guideline can only be submitted via the standard grants assessment process. Matters under this guideline are treated the same as State equal opportunity matters, with the allocation of work guideline also applicable.

A lawyer seeking a grant of legal assistance should submit an application via ATLAS for assessment, including all of the following documents:

  • documentation/legal opinion of why there is a strong prospect in this matter of benefit to the person making the application
  • reference to how the matter meets the State reasonableness test
  • relevant proof of means.

Note

The State reasonableness test applies to this guideline, not the Commonwealth merits test.
