Fee Schedule 6 – Fees in war veterans’ cases

General principles for war veterans’ matters at the Administrative Appeals Tribunal

The lawyer must give Victoria Legal Aid (VLA) a completed war veterans' matters checklist at the end of Stage 1. VLA will extend the grant of assistance or pay a claim for professional costs only if the checklist is received.

If a stage is completed on or after the date on which a fee limit changed, then the fee limit will be that which applies at the date of the completion of the grant.

The fees in tables U, U(i) and U(ii) and U3 are lump sum fees and include all work within the stage. The lump sum fee will only be payable when the stage is substantially completed. In the event that the stage is not substantially completed an itemised bill calculated at 64 per cent of the Federal Court Scale, but not exceeding the lump sum, should be submitted.

An extension of assistance is required where the matter proceeds to Stage 2.

No provision is made in the tables for solicitor instructing.

In the event that solicitor appears as counsel the fee payable shall be the fee otherwise payable to counsel.
